My first interaction with Heather Nalley was as a district court judge presiding over a domestic violence case, so I had the pleasure to see her in action firsthand and from a detached perspective. Despite all the pressure put on her and her client by the prosecution and, admittedly, the court, to tender a plea, Ms. Nalley was thoroughly professional and pleasant while zealously advocating for her client and his right to a jury trial. Her style is not in your face but rather calm, collected and logical. Always polite, I watched as she picked apart the prosecution’s case without undue hyperbole or harshness, all the while being endearing to and engaging with the jury. While I never expected it beforehand, by the time the jury began deliberations, there was no doubt in my mind that a not guilty verdict would be returned, as it was.
Therefore, unfortunately, when I found myself accused, I immediately turned to Ms. Nalley based on my own experience and observations. As you can imagine, being a judge probably made me most attorneys’ nightmare client—and rightly so because I understand the system and was righteously indignant at being on the other side of the bench. I had my own ideas on how my defense should be handled and wasn’t afraid to share my thoughts with Ms. Nalley, sometimes quite strongly. But she is unflappable and was able to manage a client used to issuing orders and having them followed. Many a time she talked me off the ledge to my own benefit and the judge in my case even commented on how professional and cordial she and the prosecutor interacted despite the prosecutor’s clear intent to make me a notch in her belt.
Although we thoroughly prepared for my jury trail and were ready to proceed to what, I’m confident, would have been a favorable verdict, Ms. Nalley stood up to the prosecution’s pressure to enter into a plea agreement and was able to secure a dismissal in my case. Without qualification, I highly recommend Ms. Nalley as your defense attorney in any criminal matter; she is knowledgeable, prepared and disarmingly pleasant while being a true advocate ready to go to trial when you need it!
