The Importance of a Durable Power of Attorney

A durable power of attorney is important because if one is to become incapacitated the person chosen to be POA will still be able to make decisions beyond that point. A Durable Power of Attorney will be able to make medical emergency decisions and make sure one’s finances are handled. Having someone assigned as a Durable POA will take care of any medical decisions that are required while one is incapacitated, releasing the loved ones of that burden. 

Power of Attorney vs. Durable Power of Attorney

A Power of Attorney is when a person is giving the responsibility of making decisions related to another’s finances and legal matters. A general power of attorney is able to handle anything involved with one’s finances and some legal matters.  The POA document becomes invalid the second that person becomes incapacitated. A durable power of attorney remains in effect and allows that person to continue making those decisions, as well as, medical decisions once one has become incapacitated. This document only comes to an end once one has died.
